We are surprised not to have received a response from the several contacted organizations, particularly those in the educational sector. Given the nature of the information shared, we would have thought these institutions might be concerned with:

  • Safeguarding Obligations: The statutory duty to act upon information regarding the safety and welfare.
  • Negligent Misstatement: The legal risk of maintaining a public endorsement or reference that may now be factually misleading.
  • Insurance Disclosure: The requirement to notify professional indemnity insurers of any known “material risks” linked to their associated partners.
  • Regulatory Compliance: Potential conflicts with ISI (Independent Schools Inspectorate) or Ofsted frameworks regarding professional associations and reputation.
  • Duty of Care: The broader liability involved in vouching for an entity facing active allegations of physical harm.

We request their insurer.
